Agreement to Terms

By accessing or using TrendTide's website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, then you may not access our services.

Services Provided

Services are provided as outlined in client contracts or agreements. TrendTide offers marketplace management services including but not limited to:

• PPC (Pay-Per-Click) Management
• Exclusive Brand Partnership Services
• Marketplace Operations & Listing Optimization
• Performance Marketing
• Marketplace Growth Strategies

Performance Guarantees

TrendTide strives to deliver exceptional results but does not guarantee specific sales outcomes. Results may vary based on multiple factors including market conditions, product quality, competition, and other external factors beyond our control.

Client Responsibilities

Clients are responsible for:

• Providing accurate and updated product and company information
• Maintaining product quality and inventory availability
• Complying with marketplace policies and regulations
• Making timely payments as agreed in the contract
• Providing necessary access and permissions for marketplace accounts
• Informing TrendTide of any changes that may affect service delivery

Intellectual Property

All TrendTide content, reports, and data remain TrendTide's intellectual property unless otherwise agreed in writing. This includes but is not limited to:

• Campaign strategies and optimizations
• Performance reports and analytics
• Proprietary tools and methodologies
• Written content, designs, and creative materials created by TrendTide

Clients may use TrendTide-created content for their business purposes as outlined in the service agreement, but may not reproduce, distribute, or claim ownership of TrendTide's intellectual property without written consent.

Payment Terms

Payment terms will be specified in individual service agreements. Clients agree to pay all fees as outlined in their contract. Late payments may result in service suspension or termination.

Termination

Either party may terminate the service agreement in accordance with the terms specified in the contract. Upon termination, clients remain responsible for all fees incurred up to the date of termination.

Limitation of Liability

TrendTide shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our services. Our total liability shall not exceed the total amount paid by the client in the twelve (12) months preceding the claim.

Governing Law

Any disputes will be governed by the laws of Texas, USA. Any legal proceedings related to these terms shall be conducted in the courts of Texas, USA.

Changes to Terms

TrendTide reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
